BASIC INFORMATION OF XMACNA ABOUT PERSONAL DATA PROTECTION

PERSONAL DATA PROCESSING

Processing of personal data means - according to the GDPR - any operation or set of operations carried out with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or making available in another form, comparison or combination, restriction, deletion or destruction.

PURPOSE OF PROCESSING AND STORAGE

The purpose will be the proper organization and/or provision and/or dissemination and/or communication and/or promotion of the services offered via WhatsApp, Telegram, and webchat in the form of DIGITAL EMPLOYEES, as well as those found on the xmacna.ai website. The processed personal data will be retained as long as the data subject remains linked to our Xmacna service for reasons including use of the Application, contractual relationship, as a contact, or for legitimate reasons by the controller, and until deletion is requested by the data subject; in any case, the data will be retained for as long as necessary to fulfill legal obligations.

Once the purpose for which the data was collected or accessed has been fulfilled, it will be deleted in accordance with the provisions of the regulations on the protection of personal data. This means, where appropriate, that the data will be blocked without access, so that it can only be made available upon request from the relevant authorities empowered to require access (for example, law enforcement agencies, judges, and courts), and during the period of limitation for any potential actions that may arise; once this period has expired, the data will be completely deleted.

The personal data are processed and hosted in cloud on Microsoft servers from Microsoft Azure, with the Data Center located in called “South Region of Brazil” in São Paulo, and with mirroring to the USA.

RIGHTS OF THE INVOLVED PARTIES

The data owners of personal data have the right to exercise, at any time and free of charge, the right to request: access, rectification, deletion of personal data that we process, restriction or objection to its processing, processing and portability of the same, as well as the right to not be subject to automated decisions.

To revoke your consent or exercise your rights, you must send a notification requesting the exercise of the specific right, addressed to the Data Controller, who must be directed to the following address: lgpd@xmacna.ai. We may take reasonable measures that we consider necessary to verify the identity of the data subject who is exercising any one of the rights listed.

Information that we collect

The personal information requested and the reasons for requesting it will be clearly explained to you at the time you are asked to provide your personal information. If you contact us directly, we may receive additional information about you, such as your name, email address, phone number, the content of the message and/or attachments you send us, and any other information you choose to provide. When you register for an account, we may ask for your contact information, such as your name, company name, address, email address, and phone number.

We collect the phone number and the nickname (name, phrase, or emoji) you set up on the platform to identify yourself, as well as any information you send through the chat feature.

Finally, we would like to emphasize and highlight that the data we may request from you are, in general, those necessary to fulfill the purposes of our services; therefore, if they are not provided to us, or not provided correctly, we will not be able to fulfill your requests.

How we use your information

We use your information for the following purposes:

to monitor interactions with our emails;
to protect our interests or the interests of third parties;
to improve our service;
to provide the service you requested;
to comply with our legal obligations;
to enter in contact with you;
to fulfill or perform fulfill our contracts;
to provide support to the client in relation to the our products;

We are not responsible for the privacy practices of any platform, website, or application that is not controlled by us.

International Data Transfers

For the execution of certain processes, for example, personal data is processed and hosted in the cloud on Microsoft Azure servers, with the Data Center located in the so-called “Southern Region of Brazil” in São Paulo, and mirrored to the USA.

Like any other site, Xmacna.ai uses cookies and web beacons. These tools collect information about visitors, including preferences and which site pages the visitor accessed or visited. Rights to the protection of personal data

We want to ensure that you are fully informed about all your personal data protection rights. Each user is entitled to the following:

Information for children with under 18 years oldage

Xmacna offers exclusive services for individuals over 18 years of age. Another of our priorities is protecting children while using the Internet. We encourage parents and guardians to observe, participate in, and/or supervise and guide their children's online activities. If you believe your child under 18 years old has provided this type of information on our website, we strongly recommend that you contact us immediately, and we will do our best to promptly remove such information from our records.

We respect your privacy and, to ensure the confidentiality, the integrity, the availability and the resilience of our systems and services of processing, we adopt the technical andorganizational measures necessary to ensure the security of the data and prevent their alteration, loss, processing or unauthorized access, taking into account the state of technology, the nature of the data stored and the risks they are exposed.
